Draft Not in force. This is a plain-language draft that needs a lawyer's read before it goes live. Anything in [square brackets] is a placeholder.
WispOS App Store Developer Agreement
The terms for putting an app in the WispOS App Store: what you let us do with it, what you promise, what you may not do, and when we can reject or remove an app.
Version 0.1, draft of October 4, 2026.
This agreement is between you, the person or organization that submits an app (the publisher), and [legal name of the business that runs WispOS] (we, us). It covers every app you send to the WispOS App Store, and every update to it.
You accept it by submitting an app. If you submit for an organization, you’re telling us you can agree to it on the organization’s behalf, and “you” means the organization.
We’ve kept it in plain words. The rules for what gets listed are in How app review works; this agreement makes them part of the deal.
Words we use
- WispOS means the WispOS app on every device it runs on, Wisper, the App Store, the store’s catalog and these docs.
- Your app means everything you send us for an app: its code, art, sound, text, data, its agent’s instructions and knowledge files, its help pages, and its listing (name, icon, screenshots, summary, description, privacy label). It includes every update.
- Users means the people who install or use your app through WispOS.
You keep what’s yours
You keep ownership of your app. Nothing here transfers your copyright, your trademarks or anything else you own. The license below is what lets us do our part.
The license you give us
You give us a worldwide, non-exclusive, royalty-free license to:
- Review your app: run it, read its code and files, take it apart to see what it does, and test it on our own devices and accounts. People who help us review (employees and contractors) can do the same, under a duty to keep it confidential.
- Pack and sign it: turn your folder into a WispOS package, check it, and sign it with our key so WispOS can tell it came through the store. We don’t change what your app does; if a change is needed, we ask you to make it.
- Host and distribute it: store it, copy it, and deliver it to users, including updates, through the store and its catalog, worldwide unless you tell us where it may not be offered.
- Show it: use your app’s name, icon, screenshots and listing text in the store, and in material about the store (for example a “new in the store” post), without suggesting you endorse anything beyond your app being listed.
The license lasts as long as your app is listed, and after that for as long as we need to: keep a copy for our records, keep it working for users who already installed it, and deal with any claim about it.
Users get a license from you to install and use your app on their own devices. If your listing links your own license terms, those apply between you and the user. If it doesn’t, users may use your app for their own personal or internal use, and may not resell or redistribute it.
What you promise
You promise that:
- You have the rights. You made your app, or you have the right to publish every part of it (code, art, music, fonts, data, model output, other people’s work) in the way this agreement describes, and you follow the licenses of anything third-party in it.
- It doesn’t infringe. Your app and its listing don’t infringe anyone’s copyright, trademark, patent, privacy, publicity or other rights.
- It’s honest. Your app does what its listing says. The privacy label, permissions and network addresses are true and complete. You tell us about every part of your app that a reviewer might not see.
- It’s lawful. You follow the laws that apply to your app and to you, including privacy and data-protection law, consumer law, and export and sanctions rules. You are not on a sanctions list.
- It’s safe. Your app contains no malware and nothing meant to harm users, their devices, their data, WispOS or us.
- You’re reachable. The contact details you gave us are right, and you’ll keep them up to date. [Minimum age for an individual publisher: 18?]
If any of this stops being true, tell us at [email protected] straight away.
What you may not do
These protect users and protect WispOS. You may not, and your app may not:
- Get around WispOS. Reverse engineer, decompile or tamper with WispOS, except where the law gives you a right to that can’t be waived. Escape or weaken the app sandbox, its permissions, the package format’s checks or our signing. Use WispOS’s interfaces in a way they aren’t documented for.
- Get around review. Behave differently while it’s being reviewed, hide features, or turn on behavior after review: through downloaded code,
evalof fetched text, remote switches, or anything else. - Be a store. Act as a store, catalog, marketplace or installer for other apps, agents, plug-ins or code, or side-load software that hasn’t been through our review. (Content your app is plainly about, like levels for your game, is fine if it isn’t code.)
- Reach for data that isn’t yours. Read, collect, copy or send a user’s HQ folder, Wisper’s memory or conversations, their teams, projects or files, or another app’s or agent’s data, beyond what your declared permissions allow and your listing says. Never sell or share it.
- Abuse Wisper or other agents. Try to steer, override or impersonate Wisper, another agent or a WispOS system message: hidden instructions, prompt injection, pretending to be the user, or getting an agent to act outside its subject.
- Pass off as WispOS. Copy WispOS’s own screens, features, look or wording wholesale so that your app could be mistaken for part of WispOS, or present it as official, built in, made by us or endorsed by us. Building something that does a similar job, in your own design, is fine.
- Misuse the store. Manipulate ratings, rankings or search; submit many near-identical apps; collect information about other publishers or users from the store; or use the store to advertise something you aren’t listing.
- Charge for it, yet. See Paid apps below.
Our names and marks
WispOS, Wisper and their logos, icons and look are ours. This agreement doesn’t give you any right to use them, except this:
You may say, in plain text, that your app is “Available on the WispOS App Store”, and link to its listing.
You may not:
- put WispOS, Wisper or anything confusingly like them in your app’s name, icon, publisher name, domain or social handles;
- use our logos or icons, or a badge we haven’t published for that purpose;
- say or suggest that we made, sponsor, partner with or endorse you or your app.
If we publish official store badges later, you can use those under the rules that come with them.
Review, rejection and removal
We decide what goes into the store, and what stays there.
- We may reject any app or update, for a reason in the guidelines, for breaking this agreement, or because we don’t think it’s right for the store. We’ll tell you why when we reject it, but the decision is ours.
- We may remove an app, pause new installs, hold back an update, or stop listing a publisher’s apps, at any time. We’ll usually tell you first and give you a chance to fix it.
- When it’s urgent, we act first and tell you after, or without notice where telling you would cause harm or break the law. Urgent means things like: the app is harming people or their data, it’s a security risk to WispOS or its users, a court or the law requires it, or a credible claim says it infringes someone’s rights.
- We may also stop offering the store, or any part of it, anywhere.
Being listed doesn’t guarantee your app stays listed, is featured, ranks anywhere, or gets any number of installs. Review isn’t a promise that your app is safe, legal or free of bugs; that stays your responsibility.
Your users and their data
- You’re responsible for your app, its support and anything it collects. If it collects personal data, you need a privacy policy that matches your privacy label, linked from your listing, and a lawful basis for collecting it.
- You support your app. Users and we can reach you at the contact email on your listing.
- We don’t give you users’ personal information. We may share install counts and similar totals with you later.
Paid apps
For now the store lists free apps only. An app can’t charge for itself or anything inside it, show ads that pay you, ask for payment, or send people elsewhere to pay to unlock it.
Paid apps, in-app purchases and a revenue share will come in a later version of this agreement. Nothing here promises they’ll come, on what terms, or what share. Until then no money changes hands between us under this agreement.
Ideas you send us
If you send us suggestions about WispOS or the store, we can use them freely, without owing you anything. That doesn’t cover your app itself, which stays yours.
No warranty
WispOS and the App Store are provided “as is” and “as available”. To the fullest extent the law allows, we make no promises about them, express or implied, including that they’ll be available, work without errors, or make your app reach anyone, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Limits on our liability
To the fullest extent the law allows:
- We aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from this agreement, the store or your app, even if we were told they could happen.
- Our total liability to you for everything arising from this agreement is limited to [the greater of US$100 and the amount we paid you under this agreement in the 12 months before the claim].
Some places don’t allow some of these limits. Where they don’t, they apply as far as the law allows.
If something you did causes a claim
You will defend us, and cover our losses, costs and reasonable lawyers’ fees, if someone makes a claim against us (or our people) that comes from:
- your app, or its listing;
- your breaking a promise or a rule in this agreement;
- your breaking a law, or someone else’s rights.
We’ll tell you about the claim promptly, let you control the defense (with a lawyer we’re reasonably happy with), and help you at your cost. You won’t settle a claim in a way that admits fault for us or makes us pay or do something, without our written agreement.
Ending this agreement
- You can leave any time: email us to remove your app. We’ll take it out of the store within [5] business days. Users who already installed it keep it, and the license for them continues.
- We can end it for any app or for you, at any time, as described in Review, rejection and removal.
- These parts keep applying after it ends: the license for users and our records, your promises, the indemnity, the warranty disclaimer, the liability limits, and the general terms.
Changes to this agreement
We may change this agreement. We’ll post the new version on this page with a new date, and email publishers about any change that matters, at least [30] days before it applies, unless the change is needed sooner by law or to protect users. If you don’t agree to a change, you can remove your app before it applies. Keeping an app listed, or submitting one, after the change applies means you accept it.
Governing law
This agreement is governed by the laws of [state or country], without regard to its conflict-of-laws rules. Any dispute goes to the courts of [county and state, or country], and both of us agree to their jurisdiction. [Lawyer to decide: courts or arbitration, and any small-claims carve-out.]
General terms
- Whole agreement. This agreement, together with the review guidelines and the package format, is the whole agreement between us about the store. If they conflict, this agreement wins.
- Notices. We contact you at the email you gave us. You contact us at [email protected].
- Independent. We’re independent of each other. Nothing here makes either of us the other’s partner, employee or agent.
- Assignment. You can’t transfer this agreement without our agreement. We can transfer it to a company that takes over WispOS.
- Severability. If a court finds part of this agreement unenforceable, the rest stays in force.
- No waiver. If we don’t enforce a term right away, we can still enforce it later.
Before this goes live
For the owner and the lawyer. Delete this section when the agreement is final.
- The parties. Fill in the legal entity that runs WispOS and signs this. Today the site’s other terms are written as one person.
- Governing law and disputes. Pick the state or country, the courts, and whether to use arbitration or a class-action waiver.
- Liability cap and indemnity. Check the cap amount, and whether the indemnity should be mutual.
- Minimum age for individual publishers.
- Copyright notices. Whether the store needs a DMCA agent and a takedown process (a store that hosts other people’s apps usually does).
- EU and UK. Whether the store is an online marketplace under the EU Digital Services Act or UK rules, which can require collecting and checking publisher (“trader”) details and giving reasons for removals.
- Export and sanctions. Whether the store needs any export screening for where apps are offered.
- Accepting. Whether “submitting means you accept” is enough, or publishers should tick a box or reply “I agree” with a version number, which we’d keep on record.
- Paid apps. A later version needs payment terms, taxes, refunds and the revenue share.
